While all married couples would like to believe that their marriages will truly be “til death do us part,” that is not always the case. The current divorce rate in Texas is just under 4 divorces per 1000 residents. While divorce is one of the most emotionally trying experiences of ones life, that\’s not to say the process cannot be amicable if the terms of the divorce have been agreed upon.
More commonly referred to as an uncontested divorce, the process requires that both parties have already agreed upon most items such as division of assets, assumption of debts, and custody of children, if applicable. A Final Decree of Divorce can be drafted by your attorney outlining all of the decisions that both parties have come to an agreement on in advance. A Joint Parenting Agreement would need to be completed as well if minor children are involved. Child support payments are also an item that should be discussed and, if an amicable agreement is reached regarding payment amounts, if any, those details should be included in the Final Decree of Divorce. If the couple has been married long enough and spousal support may be an option, those amounts, as well as length of payments, must be calculated in advance as well.
It is highly recommended, even in the case of an uncontested divorce, that both parties retain their own legal counsel. This ensures that each person is fully aware of what terms they are agreeing to in the documents being drafted and also provides both parties to legal advice regarding documents created by the opposite party\’s representation.
