Divorce can be a difficult situation that no couple wants like to find themselves in. Unfortunately, it still happens every day. What happens next? How do we divide all of our things? I have been a stay at home mom, how will we get by?
In some divorces a party may be eligible for spousal support, which is the Texas version of alimony. In other states typically, alimony is determined on several factors: fault, who earns more money, who is supporting children, age, and length of marriage.
Spousal support is slightly different, it is the continuation of support from one spouse to another in the event of a divorce. This support can be short-term or long-term, depending on the situation and how dependent a spouse may have been. In Texas, you must prove your need for support before a judge will order it. This is determined by the income earning ability of the spouse seeking maintenance, whether or not the spouse is disabled, the length of the marriage, comparitive resources of both parties, efforts made by support-seeking spouse to obtain employment, and many others. Most of the time the length of support is capped at a determined length of time. It can be extended for special circumstances, such as inability to find work due to child care, and physical or mental disability.
