Denver Estate Planning and Probate Attorneys

A will is a legal document that reflects how you want your assets to be distributed upon your death. At the Law Offices of W. Robert Montgomery in Denver, Colorado, our lawyers help draft, finalize and revise wills and other estate planning documents.

What Legal Documents Do I Need to Protect My Family?

A properly drawn will is one way to make sure your property and belongings are distributed according to your wishes. However, there are other estate planning documents that will help protect your assets and your family:

An advance medical directive or living will enables you to tell family members and medical providers whether you want artificial life support, such as feeding tubes, if you are in a terminal condition with no hope of recovery.

A health care power of attorney gives a trusted family member the authority to make health care decisions for you if you are incapacitated and incapable of communicating for yourself.

A power of attorney gives someone else the authority to act for you and make financial decisions. A durable power of attorney allows your agent to make decisions for you even if you are incapacitated and can’t revoke the designation. A durable power of attorney can be effective immediately or does not need to go into effect until you are incapacitated.

Probate Attorneys

Our lawyers are qualified to handle the administration of estates and probate-related matters. We can assist a personal representative or an executor in preparing an inventory, accounting and schedule of distribution for gifts under a will. We can represent an estate even when the decedent passed away without leaving a will. We also advise heirs who seek assurance that an estate is handled properly.

Not all property needs to go through the probate process. Life insurance benefits, 401(k) accounts, joint checking accounts, property held in joint tenancy and assets held in trusts do not need to pass through probate. By taking steps to plan your estate while you are alive, you can ensure that your beneficiaries won’t incur the cost and delay of probate when you die.
