There are no assets and what is known as a clean break order is needed which will ensure neither you nor your spouse can claim against each other in the future;
There are assets which need to be divided and advice can be given on whether there should be discussions and negotiations to try to agree the division or whether;
If appropriate, you and your spouse could attend mediation. This is a voluntary process which would involve you both meeting with an independent mediation to see if matters can be agreed; or whether an application may need to be made to the Court to resolve matters.
There are many different types of financial orders ranging from maintenance to the payment of a lump sum of money or transfers of property. It is always necessary for first consideration to be given to the needs (and particularly the housing needs) of any children. The are other factors to be considered such as the incomes of you and your spouse, you financial resources and such things as your ages, health and contributions to the relationship.
The starting point is generally to consider whether the finances should be split equally, although there is no one right answer and any court would have a wide discretion to look at all of the circumstances.
