This February, in a ruling that is hailed as the first of its kind victory for non-traditional parents, the Kansas Supreme Court ruled that the non-biological mother of children in a same sex relationship can have the same custodial and parental rights as the biological mother.

When the lesbian couple separated after 13 years together, the biological mother moved to Texas with their two children (10 and 8 years old). However, after several legal battles, the court ruled that it was in the best interests of the children for them to have two parents and that denying one of them the legal right to parenting time would have severe implications that do not further their best interests.’
