Advice During Mediation and Agreement Reached
If you decide to use the services of a Mediator, as the process unfolds you may be advised to seek advice regarding a particular point that has arisen. Equally, before making a decision on a particular point you may wish to seek advice on the matter.
Given that your mediation is fruitful and agreement is reached, a Memorandum of Understanding will be prepared by the Mediator. He will also prepare a Statement laying out the information exchanged during the process. This is the information that your agreement relies upon. You will be advised to seek legal advice and this is important because you Memorandum of Understanding will not be legally binding until you have taken such advice.
If the mediation forms part of your divorce or civil partnership dissolution, it is usually the case that the Memorandum of Understanding is recorded by the court in the form of a Consent Order; the alternative being a formal Separation Agreement (where there are no court proceedings.) Your Mediator has a specific role and he will be unable to prepare these documents on behalf of the parties.

Advice by consultation (face-to-face via Skype, telephone, email or letter)
Obtaining information necessary to draft the document
Advising you of issues you may wish to consider or re-negotiate
Advising you of the responsibilities and implication of signing a Statement of Understanding
Drafting the agreement
Communicating with both parties confirming the terms of the agreement
Arranging for signing by both parties
Providing you with a copy of the final document
Regular updates by letter/email/phone/SMS
What is not included?
Confirming the accuracy of information relied upon as the basis for the agreement
Further investigation to confirm or clarify the financial information shared between the parties
Re-negotiation of the terms of the agreement agreed by the parties, or omissions
Drafting a Court Order or Separation Order
